1. Introduction and Agreement to Terms

  1. These Terms and Conditions (“Terms”) govern your access to and use of the website located at solarxcellence.com.au (“Site”), operated by Solar Xcellence Pty Ltd (“Solar Xcellence”, “we”, “our”, or “us”).
  2. By browsing, accessing, requesting a quote, booking a consultation, or otherwise interacting with our Site, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree to these Terms, you must cease using the Site immediately.

2. Nature of Information & General Disclaimers

  1. Informational Content Only: The content, articles, calculator estimators, guides, and package details provided on this Site are general in nature and intended for preliminary informational purposes only.
  2. Not Engineering or Financial Advice: System performance projections, battery payback calculations, energy savings estimates, and grid-tariff discussions do not constitute binding engineering, financial, or investment advice. Actual system performance depends on site-specific parameters, including roof orientation, tilt, shading, seasonal irradiation, Western Power grid export limits, and customer consumption profiles.
  3. Accuracy of Data: While we strive to maintain accurate pricing, product specifications, and regulatory details, information on the Site may contain typographical errors or technical inaccuracies. We reserve the right to correct errors without prior notice.

3. Online Quotes, Assessments & Consultations

  1. Preliminary Nature of Online Quotes: Any quote, solar audit, or savings estimation generated via online submission or booking tools on this Site represents an indicative, non-binding estimate.
  2. Site-Specific Inspections: A formal, binding contract for the supply and installation of residential or commercial solar photovoltaic (PV) panels, hybrid/string inverters, or battery storage systems requires an engineering assessment and site-specific proposal signed by both parties.
  3. Accuracy of Customer Information: You warrant that all information provided by you via online forms (e.g., current power bills, roof type, switchboard age, phases, property ownership status, contact details) is true, accurate, and complete.

4. Government Incentives, Rebates & Network Approvals

  1. Small-scale Technology Certificates (STCs) & Rebates: Where pricing on this Site indicates a net price factoring in federal STC discounts or state/federal battery rebate schemes:
    • Eligibility is determined strictly by applicable regulatory bodies (e.g., the Clean Energy Regulator) and relevant scheme rules.
    • Quotation estimates assume you will assign the right to create STCs to Solar Xcellence or its designated agent. If you are deemed ineligible or fail to execute necessary assignment forms, the full, undiscounted system cost remains payable.
  2. Network Connection Approval: System connections in Western Australia are subject to approval by the relevant Distributed Network Service Provider (DNSP), including Western Power (South West Interconnected System – SWIS) or Horizon Power. Connection approval, feed-in tariffs, inverter capacity limits, and export limits are governed by the respective network operator and are not within our unilateral control.

5. Australian Consumer Law & Warranties

  1. Statutory Guarantees: Nothing in these Terms excludes, restricts, or modifies any condition, warranty, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other applicable State or Territory legislation that cannot be lawfully excluded.
  2. Consumer Guarantees Statement: Under the ACL, our goods and services come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  3. Industry Standards: Solar Xcellence engages Clean Energy Council (CEC) accredited installers and adheres to the guidelines of the New Energy Tech Consumer Code (NETCC).
  4. Manufacturer & Workmanship Warranties: Physical products (panels, inverters, batteries) are backed by individual manufacturer warranties as specified on project agreements. Workmanship warranties apply in accordance with formal project contracts and statutory building/electrical standards.

6. Intellectual Property Rights

  1. Unless otherwise indicated, Solar Xcellence owns or licenses all copyright, trademarks, designs, patents, logos, text, graphics, images, software, and other intellectual property contained on this Site.
  2. You are granted a limited, revocable, non-exclusive license to view and download materials for personal, non-commercial use only.
  3. You must not copy, reproduce, republish, frame, modify, transmit, distribute, or reverse-engineer any part of this Site without our prior written consent.

  2. By submitting your contact details, you consent to receiving communications (via phone, SMS, or email) from our technical and customer care team regarding your solar and energy storage enquiry. You may opt out of promotional messages at any time.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Western Australia (WA) and the Commonwealth of Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia sitting in WA.
